Terms & Conditions

These terms govern your use of the AmericaRx Smart Shop LLC website and any purchase you make through it. By placing an order you agree to them.

Orders and acceptance

Placing an order is an offer to buy. A contract is formed when we confirm the order and the payment provider confirms payment. We may decline or cancel an order if an item is unavailable, if there is an error in the price or description, or if we suspect fraud. Where we cancel a paid order, we refund it in full.

Pricing and availability

Prices are shown in US dollars and exclude sales tax and shipping unless stated. Stock figures shown on product pages are updated as orders are placed, but an item may occasionally sell out before your order is processed. We correct pricing and description errors when we find them and will contact you before charging a different amount.

Payment

Payments are processed by our payment provider. Available payment methods are those the provider supports for your card and region and are shown before payment. See our Payment & Billing Information page for details.

Shipping, returns and cancellation

Delivery is covered by our Shipping & Delivery Policy. Returns, refunds and order cancellation are covered by our Returns & Refund Policy. Both form part of these terms.

Product information

We describe compatibility, features and specifications as accurately as we can using information from our suppliers. Colours may appear differently on different screens. If a product does not match its description, the Returns & Refund Policy applies.

Acceptable use

You agree not to use the site unlawfully, attempt to disrupt it, scrape it at scale, or use it to place fraudulent orders. We may suspend access where we reasonably believe these terms have been breached.

Intellectual property

The AmericaRx Smart Shop name, logo, site design, text and product photography are owned by AmericaRx Smart Shop LLC or its licensors and may not be copied or reused without written permission. Console, platform and manufacturer names used on this site are trademarks of their respective owners and are used only to describe compatibility; their use does not imply endorsement or affiliation.

Limitation of liability

To the extent permitted by law, our total liability arising from an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing in these terms excludes liability that cannot lawfully be excluded, including any rights you have under consumer-protection law.

Governing law

These terms are governed by the laws of the State of Missouri, United States, without regard to conflict of law rules.
